Terms of Service

Effective: August 15, 2026

These Terms of Service (“Terms”) govern your access to and use of SnapMyCards (the “Service”), operated by SnapMyCards (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent and warrant that you are 18 or older and are able to form a binding contract.

2. The Service

SnapMyCards lets you photograph trading cards, receive automated identification and estimated market pricing, and organize your personal collection. Card identification and pricing are powered by third-party providers, including CardSight AI, Inc. (“CardSight”).

3. Your Account

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Provide accurate information and notify us of any unauthorized use.

4. Your Content and How It Is Processed

You retain ownership of the photographs and collection information you submit (“Your Content”). You represent that you own, or have all rights necessary to submit, Your Content and that it does not infringe any third party’s rights.

Third-party processing & AI training. To identify cards and retrieve pricing, images and data you submit are transmitted to and processed by CardSight. As described in CardSight’s terms, CardSight may use submitted data to operate, improve, and train and refine its artificial-intelligence models. By using the Service, you consent to this processing. See our Privacy Policy.

You grant us a non-exclusive, worldwide license to host, store, process, and display Your Content solely to operate and improve the Service for you.

5. Acceptable Use

You agree not to, and not to permit any other person to:

resell, redistribute, sublicense, or otherwise make the Service or its identification or pricing features available to any third party on a standalone basis;
use the Service to create, populate, or maintain a standalone database, catalog, or dataset of trading-card or collectibles information, or to scrape, cache, or store the underlying data except as strictly necessary to use your own collection within the Service;
reverse engineer, decompile, or attempt to derive the source or underlying data of the Service or its providers;
bypass, disable, or circumvent any rate limit, usage quota, security, or access control;
upload unlawful, infringing, harmful, or malicious content, or content you lack the rights to;
access another user’s account or use the Service in violation of any law or third-party terms.

6. Estimated Values — Not Appraisals

Pricing and valuations are estimates generated from third-party marketplace data and are provided for general informational purposes only. They are not appraisals, offers, or guarantees, may be inaccurate or out of date, and must not be relied upon for buying, selling, insurance, tax, or investment decisions. All pricing is provided “as is.”

7. Third-Party Services and Materials

The Service depends on third parties, including CardSight and cloud providers. Card images, identification data, and pricing are “third-party materials” provided “as is” and may be subject to those third parties’ terms. We do not control and are not responsible for third-party materials or their accuracy, availability, or legality.

8. Intellectual Property

The Service, including its software, design, and branding, is owned by us or our licensors. We grant you a limited, revocable, non-transferable license to use the Service for your personal use in accordance with these Terms.

9. Suspension and Termination

We may suspend or terminate your access at any time for violation of these Terms or to protect the Service or other users. You may stop using the Service at any time. Upon termination, your right to use the Service ends.

10. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IDENTIFICATIONS OR VALUES WILL BE ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $100.

12. Indemnification

You will indemnify and hold us harmless from any claims, losses, and expenses arising out of Your Content, your use of the Service, or your breach of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated effective date. Your continued use of the Service after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. The exclusive venue for disputes is the state and federal courts located in Delaware.
